These Product Drop Terms & Conditions ("Terms") govern participation in any product drop, draw, launch, queue or allocation process ("Product Drop") operated by Booghe Toys ("Booghe", "we", "our", or "us") through the EQL platform.
EQL administers the allocation process on behalf of Booghe. Any contract of sale is formed solely between Booghe Toys and the customer.
Product Drops are a method of allocating the opportunity to purchase products and are not a lottery, raffle, prize draw, or prize competition. Selection only provides the opportunity to purchase the relevant product.
By submitting an entry into a Product Drop, you agree to be bound by these Terms.
1. Overview
Booghe may use EQL's Run Fair® technology to allocate access to limited, exclusive, high-demand, or low-stock products ("Product Drops").
Participation does not guarantee the right to purchase. Submission of an entry constitutes a request to be considered for selection.
Products are allocated using EQL's proprietary Run Fair® technology and anti-bot systems. The operation of the allocation process is confidential and may include automated fraud prevention, duplicate detection and other integrity checks.
2. Eligibility
You must:
• Be at least 18 years old or have permission from a parent or legal guardian.
• Provide accurate and complete information.
• Have a valid email address.
• Have a valid payment method.
• Reside in a country to which Booghe currently ships.
Booghe may reject or cancel entries that do not meet these requirements. Orders cannot be fulfilled where prohibited by export controls, trade sanctions or other legal restrictions.
3. Entry Process
Enter your email, verify it, select any variant, complete the £0 verification checkout (or £0 authorisation process), and submit your entry. An entry confirmation only confirms receipt of your entry and does not guarantee selection, allocation or purchase.
4. Selection Process
Entries are processed using EQL's proprietary Run Fair® allocation technology. The methodology is confidential. Checks may include duplicate detection, fraud prevention, bot detection, payment verification, reseller prevention and fair allocation controls.
Booghe may consider unusually high purchase activity, multiple linked accounts, repeated purchases of limited products, shared payment methods, shared delivery addresses or other indicators when assessing suspected reseller activity. Booghe and EQL may disqualify fraudulent or abusive entries. Decisions are final.
5. Run Fair® Fee
Where applicable, the fee is shown before entry, charged only if selected, collected alongside the product price and collected by EQL to support the operation of its Run Fair® allocation technology. Unless required by law, the fee is non-refundable.
6. Payment Authorisation
A £0 or nominal authorisation may be required. It is not a purchase, does not reserve stock and does not guarantee selection. Release timing depends on your payment provider.
7. Successful Entries
If selected, payment will be processed automatically. Ownership transfers only after payment is received and the order accepted. Failed payment may result in forfeiture and reallocation.
8. Unsuccessful Entries
No product charge or Run Fair® Fee will apply. Booghe is not obliged to offer another purchase opportunity.
9. Product Availability
Subject to stock, supplier allocation, manufacturing delays, licensing and shipping restrictions. Booghe may cancel, amend quantities, modify launch dates or withdraw products. Cancelled paid orders will be refunded.
9A. Pricing Errors
Prices displayed at entry are subject to correction in the event of genuine pricing errors. Booghe may cancel affected orders before dispatch and refund amounts paid.
10. Product Limits
Limits may apply per customer, household, address, payment method or other identifying information.
11. Order Cancellation
Booghe may cancel orders for fraud, failed verification, inaccurate shipping information, duplicate purchases, suspected reseller activity, platform abuse, legal requirements or circumstances beyond its reasonable control making fulfilment impossible. Refunds will be issued where applicable.
12. Shipping
Standard delivery terms apply. Dispatch dates are estimates. Delays caused by manufacturers, couriers, customs or events beyond reasonable control including strikes, cyberattacks, pandemics, severe weather, supplier failures, government action, legal changes or export restrictions are not Booghe's responsibility.
13. Returns and Consumer Rights
Nothing limits your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other applicable law. Standard Returns Policy applies unless otherwise stated.
14. Platform Availability
Access may be interrupted by technical issues or third-party failures. Booghe is not responsible for entries not received due to circumstances beyond its reasonable control.
15. Limitation of Liability
Booghe is not liable for loss of opportunity, indirect losses, loss of profits, data loss or technical failures beyond its control. Nothing excludes liability that cannot legally be excluded.
16. Privacy
Data is processed under Booghe's and EQL's Privacy Policies and in accordance with UK GDPR and the Data Protection Act 2018. Information may be shared with EQL for administration, payment processing, fraud prevention, identity verification and fair allocation.
17. Changes
Booghe may amend these Terms. The version in force at entry will generally apply unless changes are required by law.
18. Governing Law
These Terms are governed by the laws of England, Wales and Scotland and disputes are subject to the exclusive jurisdiction of its courts.
